Terms of Service

These Terms of Service ("Terms") govern your use of donorcare.my, the public NPO directory, and any donation checkout page hosted by Omakase Software Sdn Bhd ("DonorCARE", "we", "us") on behalf of a customer organisation ("Organisation"), when you are visiting or donating as a member of the public ("you"). By using these surfaces, you agree to these Terms.

If you are an Organisation using the DonorCARE admin dashboard to manage your own account, campaigns, and donors, the agreement that governs that relationship is our Subscription Terms, not this page.

DonorCARE is a technology platform that lets Malaysian nonprofit and religious organisations accept donations, issue tax-deduction receipts, and manage donor relationships. We provide the software and payment infrastructure. We are not the Organisation you are donating to, we do not select which causes appear on the platform beyond basic verification of an Organisation's registration, and we are not responsible for how an Organisation uses the funds it receives.

When you donate through a DonorCARE checkout, you are entering into a transaction with the Organisation you selected, not with DonorCARE. DonorCARE processes the payment on the Organisation's behalf through our payment gateway partner, CHIP, and issues a receipt using the templates and tax-registration details the Organisation has configured.

You are responsible for entering accurate donor information, including your name and identification number where you want a tax-deductible receipt. An inaccurate identification number may prevent LHDN from matching a receipt to your tax record. See our Refund Policy for how refunds, duplicate charges, and receipt corrections are handled.

The public directory lists Organisations that use DonorCARE and have opted to appear in it. Listing information (registration status, category, description) is supplied by each Organisation or drawn from public registry data, and we do not independently verify every field. A listing is not an endorsement by DonorCARE of an Organisation's cause, governance, or use of funds. Report a listing you believe is inaccurate or fraudulent to [email protected].

You agree not to, in connection with donorcare.my or any DonorCARE-hosted checkout:

• Provide false donor or payment information, or make a donation using payment credentials you are not authorised to use;
• Attempt to interfere with, disrupt, or gain unauthorised access to the platform or another user's account or data;
• Scrape, harvest, or bulk-extract directory or donor data other than through features we provide for that purpose; or
• Use the platform for any unlawful purpose, including money laundering or the financing of unlawful activity.

Where a donor portal account is available, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorised access.

The DonorCARE name, logo, and platform software are the property of Omakase Software Sdn Bhd. Content published by an Organisation on its own DonorCARE-hosted pages (its name, logo, description, and campaign copy) remains that Organisation's property. Nothing in these Terms transfers ownership of either party's intellectual property to the other.

The platform is provided "as is" without warranty of any kind, to the fullest extent permitted under Malaysian law, including the Consumer Protection Act 1999 where it applies. We do not warrant that the service will be uninterrupted or error-free. We do not guarantee the accuracy of directory listings, the tax-deductibility of any specific donation (which depends on the recipient Organisation's own LHDN tax-exemption status under Income Tax Act 1967 s44(6), not on DonorCARE), or the outcome of any e-invoice submitted through MyInvois.

To the fullest extent permitted by Malaysian law, DonorCARE's total liability to you arising out of or relating to your use of donorcare.my or a DonorCARE-hosted checkout will not exceed the amount of the donation giving rise to the claim, or RM 100 where no donation is involved, whichever is greater. We are not liable for indirect, incidental, or consequential loss. Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud or wilful misconduct.

These Terms are governed by the laws of Malaysia, including the Contracts Act 1950, without regard to conflict-of-law principles. Any dispute arising from these Terms is subject to the exclusive jurisdiction of the Malaysian courts.

We may update these Terms from time to time. Continued use of donorcare.my or a DonorCARE-hosted checkout after an update constitutes acceptance of the revised Terms. The "Last updated" date above reflects the current version.
